Pardarshita filed PIL in High Court


Notice issued by Delhi High Court to Delhi Govt. against violation of RTE ACT

Article 21 A of Constitution states that “Every child between the ages of 6 to 14 years has the right to free and compulsory education.” Not only this RTE Act has also been enacted since 1st April 2010 and according to Section 3 (1) & 3(2) of Right to Education Act

Section 3(1)“Every child of age of six to fourteen years shall have a right to free and compulsory education in a neighborhood school till completion of elementary education”

Section 3(2)“no child shall be liable to pay any kind of fee or charges or expenses which may prevent him/her from pursuing and completing the elementary education”.

But surprisingly, government school Authorities, who are supposed to be aware of this Act, are not abiding by the same. Principals of Government Schools are collecting Rs 97 from the students of Class I to VIII in the name of Parents Teachers Association Fund and Pupil Welfare Fund. This is not one time collection but the students have to pay Rs 45 quarterly for pupil Welfare Fund

When such violations came to the notice of Pardarshita by the students, then more than 500 students were assisted by Pardarshita in raising their voice against violation. A complaint with the Delhi Govt. and Chairperson of NCPCR and DCPCR was filed. More than three months have been passed but no action by any of the authority has been taken so far. Therefore Pardarshita has filed a PIL in Delhi High Court with the help of Divya Jyoti Jaipuriar, Advocate HRLN for violation of RTE Act and today Hon’ble High Court has issued notice to Delhi Govt. in this matter.

नगर निगम शिक्षक संघ (MCTA) का टाउन हाल पर प्रदर्शन


नगर निगम शिक्षक संघ (MCTA) ने आज अपनी विभिन्न मांगों को लेकर टाउन हाल पर विशाल प्रदर्शन किया।आज तक नगर निगम के शिक्षकों को छठे वेतन आयोग के एरियर का भुगतान नहीं हुआ है। इसे लेकर शिक्षकों में काफी रोष था और रही सही कसर पुलिस ने पूरी कर दी जब टाउन हाल की तरफ जाने से रोक दिया। शिक्षक सड़क पर बैठ गए और पुरानी दिल्ली रेलवे स्टेशन जाने के मार्ग को बंद कर दिया।काफी बड़ा जाम लग गया और स्वर्गीय करतार सिंह जून के समय की याद ताज़ा हो गयी।
नगर निगम शिक्षक संघ (MCTA) के वर्तमान महासचिव उनके पुत्र जोगेंद्र जून हैं और दिल्ली का शिक्षक समाज उनमें उनके पिता की ही छवि देखना चाहता है।
नगर निगम शिक्षक संघ का एक महान इतिहास रहा है। इसने अनेक शिक्षक नेता दिए हैं और सच तो यह है कि यह दिल्ली में शिक्षक नेता बनाने की मातृभूमि है। हम सभी डेल्टा (DELTA) के लोग भी इसी से पैदा हुए हैं। इसलिए इस संस्था का सम्मान हम हमेशा करते रहेंगे और इसको हमेशा जीवंत बनाये रखेंगे। इस संस्था ने न केवल शिक्षक नेता दिए हैं बल्कि इसी के सहारे अनेक लोगों ने दिल्ली के राजनीतिक गलियारों में जगह बनायी है। अनेक शिक्षक नेता इसी से निकल कर विधायक और पार्षद बन गए। अभी अभी निवर्तमान महासचिव जय भगवान यादव को इसी संस्था ने भारतीय जनता पार्टी के टिकट पर पार्षद बना दिया और वे दिल्ली नगर निगम की स्टैंडिंग कमेटी के सदस्य भी हैं।
शिक्षक नेताओं को राजनीति में जाना चाहिए या नहीं... यह प्रश्न आपके लिये छोड़ा जा रहा है... हम इस विवाद में पड़ना नहीं चाहते....

नगर निगम के प्रधानाध्यापकों को कैट में जीत मिली



आज माननीय कैट (CAT) ने दिल्ली नगर निगम के सभी प्रधानाध्यापकों को एक बड़ी खुशखबरी दी है।

ये प्रधानाध्यापक रिटायर होने के बाद पुनः दो वर्ष के लिये नियुक्त हो सकते हैं।

कुछ दिनों पहले श्री गिरिराज शर्मा एवं अन्य प्रधानाध्यापकों ने कैट (CAT) में एक केस दाखिल किया था कि उन्हें भी टी जी टी की तरह रिटायर होने के बाद 62 वर्ष की उम्र तक पुनः नियुक्ति मिले। आज कैट (CAT) में इस मुद्दे पर फैसला आ गया है और शिक्षक समाज की जीत हुई है। प्रधानाध्यापकों को पुनः नियुक्ति मिलेगी साथ ही इन्क्रीमेंट भी मिलेगी।

Sub: Withdrawal of call for Indefinite Strike by the JAC of Staff Associations of NVS – Reg

Ref: Discussions of the representatives of JAC with the Hon’ble Secretary, Department of School Education and Literacy, Govt. of India dated 28-01-2010.

It is hoped that by now, you would have received the copy of minutes of the meeting of the JAC of Staff Associations of NVS with the Hon’ble Secretary, Department of School Education and Literacy, Govt. of India, forwarded by us to all the JNVs, by E-mail dated 29-01-2010.

In the same context, we bring to your knowledge and information the events that took place in a chronological sequence.

1. 23-01-2010: - A meeting of the JAC was convened at PUNE, where at discussions at threadbare were held and decided to observe indefinite strike w.e.f 01-02-2010.

2. 25-01-2010: - While the meeting was in progress at PUNE, we have received a call from the NVS headquarters office inviting the JAC representatives for a dialogue. Accordingly, all the members of the JAC met with the Hon’ble Commissioner NVS on 25-01-2010, where at no positive assurance came from the NVS administration. As such we were forced to inform the NVS of our resolute stand on the indefinite strike w.e.f 01-02-2010.

3. 27-01-2010: - JAC fired the shot to NVS headquarters intimating the irrevocable decision of indefinite strike w.e.f 01-02-2010 as there was no assurance on our demands. The same evening, the JAC representatives received call from Shri. Alok Varma, Joint Commissioner(Admn), NVS , New Delhi, to the effect that the Commissioner, NVS has arranged a meeting with the Hon’ble Secretary, Department of School Education and Literacy, Govt. of India, New Delhi on 28-01-2010 and extended invitation to attend the same.

4. 28-01-2010: - The representatives of JAC who had already reached their respective places, had to fly to New Delhi, for the important meeting with the Secretary. The meeting was preceded by another meeting with the commissioner NVS at Shastri Bhavan on the forenoon of 28-01-2010. (The present commissioner, NVS is holding the post of Joint Secretary in the department of elementary education.) where at the commissioner advised all the JAC representatives to be pragmatic in the issue. Later late in the evening Smt. Anshu Vaish Hon’ble Secretary took the most crucial meeting with the JAC representatives. She heard us patiently and appreciated our genuine and most legitimate demands. She had assured that she will take up the issues with the secretary, finance ministry effectively in the days to come. During the discussions with the commissioner, NVS and the secretary (SE&L), it was assured that a meeting would be arranged with the Hon’ble HRM between 02-02-2010 and 15-02-2010.

The JAC could gauge sincerity and honesty in the statements of the secretary (SE&L) and the commissioner, NVS. Moreover the proceedings of the meeting were recorded in shape of minutes and communicated to all.

In the above circumstances, the JAC felt that it would be wise to allow some more time to the Government in the direction of viewing and reviewing the just and legitimate demands of the staff. Hence, we have a unanimous decision to withdraw the call for indefinite strike.

The JAC shall continue to wage relentless struggles in achieving our just demands of CCS Pension 1972 pattern and 10% special allowance to non-teaching staff in particular and all other genuine demands in general. Since this is the first time in the annals of NVS that an assurance to solve our problems was given in written shape which the JAC had to honor. This is our collective victory.

We may further inform that the JAC met with the Joint Commissioner (Admn.) and Joint Commissioner (Pers.), NVS headquarters, New Delhi, Separately on 29-01-2010 and discussed all the outstanding demands of the staff and requested for time-bound solution. They have advised us to submit issue wise representations, for finding speedy solutions and expedite solution. Following are the main issues discussed

a) Adhoc bonus to teaching staff.

b) Grant of Senior scale / ACP to teaching and non-teaching staff.

c) Grade pay of Rs 1800/- to group D employee.

d) Exemption of license fee to non-teaching staff.

e) One day token strike on 16-11-2009.

f) Modification of recruitment rules.

g) Restoration of Pay-Scale of Assistant, Audit Assistant, P-A, OS and SO.

h) ACP to drivers.

i) Earned Leave to vacation staff.

j) Ex-gratia to be paid to diseased employees families of Rs. 30,000/-

k) Creation of PGT post in Modern Indian languages.

l) Uniforms and Text-Books.

Friends, let us watch the developments. If any sabotage is attempted to water down our moment and unity, we shall roar like lions and plunge into the action with re-doubled vigour in the days to come.

A Good book on RTI by Suchi Pandey


We got to review a good book on RTI (Right to Information Act 2005, A Primer) written by Suchi Pandey and Shekhar Singh, senior founder members of NCPRI, well known national personalities in the public domain.

Yet, I had no ability to review such books which is written by Mr Shekhar Singh who is one of the best candidates to be appointed as Hon'ble Chief Information Commisioner in place of Hon'ble Wajahat Habibullah (present CIC) of this country.

NCPRI (National Campaign for Peoples Right to Information) is one of the pioneer organisations which did struggle for the implementation of this act in INDIA.

This book is really a nice work on RTI act which contains many 'frequently asked quesions' (FAQ) too written in simple language required from time to time for an RTI activist.

New Book of Mr Raj Kishore Sharma is released now


Dear friends,
A new book written by Mr.Raj Kishore Sharma, the present General Secretary of Government School Teachers' Association (GSTA), Delhi has been published now. The book named as "Pay & Other Entitlements after 6th CPC" is a good work done by him. As you know, he is the author of 'Delhi School Manual' also, which is a reference book being used in all schools and offices of Education Deptt. This book is more popular than "Swamy's Handbook" in Schools of Delhi. You will get a lot of information about pay & other entitlements written in a very simple language which is really needed after Sixth Pay Commission.
Unfortunately, this book is totally silent on the process of Bunching which is MOST needed aspect in pay fixation and this lacuna was not expected.
Mr Raj Kishore Sharma is a 'Dictionary' of rules and policy matters. Teachers always consult him for clarification on different circulars and notifications issued by the Govt from time to time.
I respect him personally.
The present book is really worthy and useful for all of us. You may get this book on leading booksellers.
We request him to compose some more books on different allowances in coming future.

Dear Mr. Tiwari,

We got your reference from Hon'ble CIC and learned that you have been working on compliance to Section 4 of the RTI Act.
It is in this regard that we would like to invite you to a half day seminar on ‘RTI: New Dimensions in Effective Implementation and Reach’ to be held on 04.11.09 between 2:00-5:00 pm at Scope Complex, Lodhi Road.
The seminar is been organized by Rakshak Foundation, a group of young people, based in California and JOSH, working with young people across different colleges and Universities on issues of transparency and accountability using the Right to Information.

Mr. Shailesh Gandhi (Central Information Commissioner) and Ms. Aruna Roy (RTI activist and Magsasay Award Winner) have already confirmed their participation in the panel of this seminar.

The seminar will provide a platform to discuss the Right to Information Act, how it could be better implemented so most of the mandatory disclosers are put in the public domain i.e. proper implementation of the Section 4 of the RTI Act and how fee structure could be changed so that it can be properly used by the NRIs. Seminar sets up a stage for the public views, questions and answer and interactions with RTI activists, Central Information Commission and academicians.

Background:

Section 4 of the Right to Information Act, which lists 17 sub clauses obligates all public authorities to proactively disclose information about its functioning. According to the RTI Act all public authorities were supposed to have implemented Section 4 within 120 days from the enactment of the Act (which is by 12th of October 2005). Section 4 is an important provision of the RTI Act, as it requires categorization and cataloging of information, presenting information in a form such that it can be accessed easily by citizens, update the information provided at regular intervals and publish all information such that it is widely disseminated.

A one day seminar was organized to discuss and understand the different requirements under the Section 4 of the RTI Act by University of Delhi along with the Central Information Commission and JOSH on the 7th June 2009. The seminar was attended by the Vice Chancellor, Pro Vice Chancellor and Registrar of University of Delhi along with Mr. Shailesh Gandhi (Central Information Commissioner), Ms. Aruna Roy (Social Activist) and Principals and Public Information Officers of 83 colleges/institutions under University of Delhi.

After this seminar, several follow-up letters have gone out to the different colleges/institutions under University of Delhi from the Central Information Commission, JOSH and University of Delhi. As a result of which some colleges have implemented Section 4 partly while the others still needs to comply with this provision of the RTI Act.

This seminar hopes to bring together people from different fields, committed to the issue of transparency and government officials to interact and understand the importance of effective implementation of all the transparency measure as per the RTI Act.
